Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MedBazaar.pk (“MedBazaar”, “we”, “us”, or “our”), an online B2B marketplace that connects medical equipment sellers, buyers, and biomedical engineers in Pakistan. By registering for or using our platform, you agree to these Terms. If you do not agree, please do not use the platform.

1. Eligibility and Accounts

• You must be at least 18 years old and legally able to enter into contracts.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• Seller and engineer accounts may require verification and admin approval before listings or profiles become publicly visible.

2. Role of MedBazaar

MedBazaar is a marketplace and communication platform only. We are not a party to any transaction between buyers and sellers, or between users and engineers. We do not own, inspect, warrant, or take possession of any equipment listed on the platform, and we do not guarantee the quality, safety, legality, or availability of any listing or service.

Any contract for the sale of equipment or provision of services is solely between the users involved. Buyers are strongly encouraged to independently verify equipment and to use the platform’s engineer inspection feature before completing a purchase.

3. Listings and Content

• Sellers must ensure that listed equipment is accurately described and that they have the legal right to sell it.
• To protect against fraud, the category and title of a listing are locked once created; other details may be edited.
• Listings require admin approval before appearing publicly and may be removed if they violate these Terms.
• You retain ownership of content you post but grant MedBazaar a non-exclusive license to display and distribute it for the purpose of operating the platform.

4. Prohibited Conduct

You agree not to:

• List counterfeit, stolen, recalled, or prohibited equipment, or items you are not authorized to sell;
• Post false, misleading, or fraudulent information, including fake reviews;
• Violate any applicable law, including import, health, and drug-regulatory requirements (such as DRAP regulations) that apply to medical devices in Pakistan;
• Circumvent platform features, misuse contact information, or harass other users;
• Upload malicious code or attempt to disrupt or gain unauthorized access to the platform.

5. Regulatory Compliance for Medical Equipment

Medical devices in Pakistan may be subject to regulation by the Drug Regulatory Authority of Pakistan (DRAP) and other authorities. Users are solely responsible for ensuring that the equipment they buy, sell, import, or service complies with all applicable registration, licensing, and safety requirements. MedBazaar does not verify regulatory compliance on behalf of users.

6. Subscriptions and Payments

• MedBazaar offers free and paid subscription plans for sellers and engineers, and optional featured-listing packages.
• Paid plans are currently activated manually after payment is received via the methods we support (such as JazzCash, EasyPaisa, or bank transfer).
• Prices are listed in Pakistani Rupees (PKR) and may change with notice.
• Unless required by law, fees are non-refundable once a plan or feature has been activated.

7. Reviews and Ratings

Reviews must be genuine and based on real interactions. We moderate reviews and may remove those that are fake, abusive, or violate these Terms. New sellers and engineers without reviews are shown as such rather than with a fabricated rating.

8. Disclaimers and Limitation of Liability

The platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, MedBazaar disclaims all warranties, express or implied, regarding the platform and any listings or services offered through it.

MedBazaar shall not be liable for any indirect, incidental, or consequential damages, or for any loss arising from transactions between users, reliance on listings or reviews, or the conduct of any user. Your use of the platform is at your own risk.

9. Indemnity

You agree to indemnify and hold MedBazaar harmless from any claims, damages, or expenses arising from your use of the platform, your listings or content, your transactions with other users, or your breach of these Terms or applicable law.

10. Suspension and Termination

We may suspend or terminate your account, or remove any content, at our discretion if we believe you have violated these Terms, engaged in fraud, or created risk for other users or the platform. You may stop using the platform and request account deletion at any time.

11. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms or the platform shall be subject to the exclusive jurisdiction of the courts of Pakistan.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the platform after an update constitutes acceptance of the revised Terms.
